A criminal defense attorney appeared in court before Judge Adele Grubbs in Fulton County, Georgia in August. His appearance, the Judge described him as “disheveled” and perspiring profusely” among other unflattering things, caused her to order him to submit to a drug test. The test apparently came back positive for cocaine. He was held in contempt and ordered to spend five days in jail.
The attorney’s history is noteworthy. He is a former Fulton County prosecutor that worked the Brian Nichols trial. After moving to private practice, he was charged with possession of drugs. According to new accounts, he is currently defending a bar grievance related to the drug charges. This history may have heightened the Judge’s concern over his appearance and behavior.
This case presents an interesting legal issues, including whether a Judge may order a test for what is essentially a charge of “Practicing Law Under The Influence of Drugs.” According to the attorney’s attorney, this is a case of first impression in Georgia.
